TERMS & CONDITIONS
Pristine Endeavors, LLC with the website domain name CleanPoolsVegas.com and DBA of Clean Pools Vegas (“Clean Pools Vegas”) strives to provide the best possible service to all our customers, but we will not tolerate any abusive or unlawful activity. We respect freedom of speech and expression unless it is harmful to others. These brief guidelines are imposed to protect you, other Pristine Endeavors, LLC customers and us against such harm. In the absence of any other Agreement, you will have accepted this Policy and these Terms and be bound by them if you use any of the services offered by Pristine Endeavors, LLC (“Services”) or otherwise indicate your affirmative acceptance of such Services.
We reserve the right to refuse service to anyone for any reason, not prohibited by law. Also, we reserve the right to terminate service to any client for any reason, not prohibited by law. Any deliberate attempt to cause harm to Pristine Endeavors, LLC in any way, will result in immediate account termination without prior notice. No refunds will be issued.
The Parties agree that Customer has contracted with Clean Pools Vegas/Pristine Endeavors, LLC to perform pool and/or spa maintenance at an address they own or are responsible for.
Should a home owner have tenants renting their home, the home owner is responsible for approvals and billing. A customer’s tenants may pay the monthly invoice, but the home owner is responsible, should the tenant default on their account or break any terms of service.
If a property is being maintained by a property management company, the property management company may contract with Pristine Endeavors, LLC directly. It is the property management’s responsibility to have their customer maintain all of Pristine Endeavors, LLC’s terms of service. If the terms of service are not upheld, the property management company is responsible for the default.
For Commercial pools, the schedule will be different than residential pools and will be agreed upon in writing, via quote acceptance. The commercial pool Client understands and agrees that delivery and completion of the ongoing pool services is contingent upon their cooperation and ability to provide their timely approval of work in progress (“Approvals”) as well as upfront payment. One point of contact, who is crucial to the decision making process, will consult with all required parties and report back to Clean Pools Vegas within 3 days. After 3 days, if we have not received proper Approval from the point of contact, a fee of $10 a day will incur until proper feedback, approvals and payment can be given.
The Parties agree that this is a yearly Service Contract and Customer agrees to pay Pristine Endeavors, LLC monthly in advance of the services to be provided that month. The Parties agree that in the event Customer fails to pay in advance of service being provided as required by this Agreement, the customer shall be required to pay a late fee of $25.
1. Service Frequency and Fees: Pristine Endeavors, LLC will provide pool service once a week at the Customer’s address. Customer agrees to pay a monthly pool service fee in advance each month for the service. Customer may request pool service twice a week for an additional cost.
The Parties agree that circumstances can arise that affect or prevent Pristine Endeavors, LLC from performing pool and/or spa maintenance such as the weather, an illness, or a holiday. In such event, Pristine Endeavors, LLC may elect to postpone pool and spa service for one week, not to exceed 4 weeks each year. However, in no event shall pool and spa service be provided during the weeks of Thanksgiving and Christmas.
In the event of inclement weather on the scheduled date of service, the pool and spa will be cleaned to the extent weather permits and only chemicals will be added. In rare cases, where the conditions are dangerous, we may skip or postpone service to the following week, as explained above.
Customer must ensure Pristine Endeavors, LLC has access to the service area on the scheduled service day, including: gate entry codes, lock combinations, security guard verification, and pets relocated from pool/spa area. If Pristine Endeavors, LLC is unable to access the service area for any reason, services will not be performed that week and Customer shall not be entitled to a credit.
Vacation/Holidays: Pristine Endeavors, LLC will be closed and service is not provided during the following weeks: Week of Thanksgiving, week of Christmas and two other weeks during the year.
These weeks are already accounted for in calculating the monthly service fee. Therefore, no credit is due. Our service is 4 times a month, which is 48 weeks. Since a year has 52 weeks, those 4 weeks are not included in the service.
In the event of an emergency during holiday or vacation, Pristine Endeavors, LLC will make every effort to return your calls and answer emails.
Emergency services are provided at a separate agreed upon rate quoted on a case by case basis.
2. Services: Pristine Endeavors, LLC shall provide the following services each week:
• Pool vacuumed as needed
• Pool surface skimmed as needed
• Filter baskets emptied
• Pump baskets emptied
• Pool equipment operation inspected
• Pool walls, floor, and tile to be brushed
as needed
• Water tested and balanced each week
Customer is responsible for water levels during the week. Recommended water level is MID-TILE.
Filter cleaning preformed only by Clean Pools Vegas is a requirement of our service. Customer agrees not to clean their own filters while Clean Pools Vegas is maintaining their pool. Clean Pools Vegas keep detailed records of all filter cleans so that we know it has been done on our cleaning schedule, to our standards and we are responsible for it. Filters will be cleaned 4 times per year, unless extra service is required. The filter cleaning fee is NOT included as part of the monthly service. Filters MUST be properly maintained in order for Pristine Endeavors, LLC to perform proper maintenance service. Any additional labor charges will be billed at a rate of $2/minute. I.E. Storm Cleanup, Excessive Debris, and any other situations out of the normal scope of work for your swimming pool.
3. Repairs: Repairs are not included in the monthly service fee. Repairs under $50 will be performed immediately and charged separately to the Customer. Repairs greater than $50 shall require Customer authorization in advance of the repair.
4. Pricing: Customer agrees to pay Pristine Endeavors, LLC the monthly service fee as well as any additional costs that may be incurred for repairs or services that are in addition to the services specified in paragraph 2 above. Additionally, Customer shall incur an additional charge of $85.00 every 3 months for filter cleaning.
5. Payment: Pristine Endeavors, LLC accepts Credit/Debit Card payment only. Each monthly payment must be received by Pristine Endeavors, LLC, in full, before the FIRST scheduled service for that month. For example, the monthly payment for October’s service must be received by Pristine Endeavors, LLC before the Customer’s first scheduled service for October.
If the card on file does not cover the payment of the monthly service fee, and any additional charges that may become due and payable, Customer shall be in default. In the event of default, services will be postponed and Customer will assessed a late fee penalty of $25. If Customer fails to cure the default, the Parties agree that Pristine Endeavors, LLC shall suffer liquidated damages as a result of the Customer’s default in the amount of $75 after 30 days in addition to that month’s service fee.
Customer agrees that the liquidated damages are in addition to the monthly service fee that remains due and payable and are intended to compensate Pristine Endeavors, LLC for damages suffered as a result of the inability of Pristine Endeavors, LLC to anticipate Customer’s default and immediately fill the void created by the default with a new customer.
Credit Cards will be left on file and payments will be automatically deducted each month. There is a 5% convenience charge on all payments over $275 made via Credit/Debit Card.
ALL credit card information will be kept on file and held for use by Pristine Endeavors, LLC only. By providing this information, Customer is authorizing Pristine Endeavors, LLC to charge the Card on File for all services provided to Customer by Pristine Endeavors, LLC pursuant to this Pool Service Agreement.
7. Disclaimer: Pristine Endeavors, LLC shall not be responsible for any damage to property due to acts of nature, fire, vandalism, misuse, or abuse. Customer should be aware of normal deterioration of equipment that occurs over time due to exposure to chemicals, sunlight, and, in some cases, other corrosive materials (i.e. salt).
By working with Pristine Endeavors, LLC, the Customer is requesting and allowing Clean Pools Vegas to take over the full maintenance of their pool and pool equipment. During the entirety of the service, Customer agrees that Clean Pools Vegas will be the only pool maintenance company or individual who shall be maintaining the pool. The CUSTOMER’S only responsibility for their pool is maintaining the correct water level at all times and netting out debris/brushing the walls, between service visits. No other pool maintenance shall be done on the Customers pool by the Customer, or any other individual/company without prior consent of Clean Pools Vegas.
For Clean Pools Vegas to properly maintain a Customer’s pool, Clean Pools Vegas has to know each and every facet of the pool, such as what chemicals were added, when and what parts were replaced. If the Customer does any maintenance to their own pool while Clean Pools Vegas is hired to maintain the pool, the Customer understands and agrees that Clean Pools Vegas is no longer responsible to fix, replace, balance or counteract anything done by the Customer. Should the Customer request Clean Pools Vegas to rectify an issue(s) which requires additional services, products or chemicals, the customer may incur additional costs to fix said issue(s). The Customer understands and accepts the full liability of damage they may cause to their pool or equipment by working on it themselves.
Services that shall not be preformed by any individual or company other than Clean Pools Vegas include, but are not limited to, adding chemicals, draining the pool, changing/cleaning filters, equipment repairs, etc. If Customer intends to hire a company to do work on the pool, that is outside of the scope of work that Clean Pools Vegas preforms, such as pool replastering, tile cleaning, resurfacing, etc., the Customer agrees to FIRST contact Clean Pools Vegas to provide an exact schedule of when the pool will be worked on.
Pristine Endeavors, LLC is not responsible for any damages or deterioration caused by failure of Customer to refrain from maintaining or working on their own pool or by failure of a Customer to accept other services recommended by Pristine Endeavors, LLC.
8. Putting An Account on Hold: Should a Customer need to put their account on hold, the customer is required to send Pristine Endeavors, LLC a 30 day written notice request via email to put their service and billing on hold. Pristine Endeavors, LLC will put an account on hold for an initial term of up to 30 days, after which, Pristine Endeavors, LLC will reach out to the customer to let them know their services will be reinstated. At that time, customer has the option to resume services or request an extension of an additional 30 day hold. The maximum allowed hold time is 60 days. After 60 days the account services and billing will automatically resume. If the customer still needs further time on hold, they will be required to cancel their account (And pay final month and cancellation fee if service has less than 12 months) and they can restart service when they are ready. By putting the service on hold for 30 or 60 days, that time does not count towards a customer’s 12 month obligation. The service contract will extend 30 or 60 days. If the customer decides at the end of their hold-period to cancel their service, they will be responsible to give 30 days written notice of cancellation, pay their final month’s bill, as well as pay the cancellation fee if it is before 12 months of service.
9. Termination: The Parties agree that this Agreement is a yearly service agreement that continues from month to month until terminated. The Agreement may be terminated by either Party. However, the Parties further agree that Customer shall give Pristine Endeavors, LLC thirty (30) days advance written notice of Customer’s termination of this Pool Service Agreement. Written notice must be by email.
Pristine Endeavors, LLC will clean and maintain the Customer’s pool, as well as provide testing and customer service, weekly. This is an automatically monthly renewable service. This agreement will automatically renew each month unless canceled in writing by the Customer at least thirty (30) days prior to the Customer’s next billing date.
We are a full service pool cleaning company. We are capable of any need or service the Customer may have. We will advise Customer of any service that may be outside of the scope of the plan they are on and will then offer recommendations about our best practices for accommodating their needs.
It is the client’s responsibility to provide Pristine Endeavors, LLC with a way to access the pool, aside from going through the home. If the pool should be non-accessible when we attempt to access the pool, Pristine Endeavors, LLC reserves the right to skip your weekly service and resume the following week or when proper access is given. Full payment is still required and no refund will be issued.
Should pet distractions, obstructions or other potentially dangerous conditions present themselves at a client’s residents, Pristine Endeavors, LLC reserves the right to skip or leave your weekly service and resume the following week or once the conditions are safe again. Full payment is still required and no refund will be issued.
Our service prices are based on the client having a working vacuum or an in-floor cleaning system. The vacuum must be used by the client at least 4 days a week, in between our weekly maintenance service day. If a customer is not keeping their pool vacuumed in between service visits, additional fees may apply.
Our service prices are also based on the client having a working filtration system. The filter must be running at least 6 hours a day during the winter months and 8 hours a day during the summer months. If Pristine Endeavors, LLC observes that your pool filter is not being kept on, additional fees may apply to continue weekly service.
Should a client’s pool filter stop working, Pristine Endeavors, LLC will advise the client on the cost and time involved to repair or replace it. During this time, Pristine Endeavors, LLC will keep the pool as maintained as possible with no filtration system, however, the client understands and agrees that Pristine Endeavors, LLC is not liable for the water quality, balance or appearance of the water during the time that there is no filtration. Pristine Endeavors, LLC will continue to maintain the client’s pool, only if the client has agreed to repair or replace the filtration system. If the client does not want to have the filtration system fixed, clean pools reserves the right to cancel the service with the remainder of the 12 month contract still due or charge additional fees to try to maintain stagnant water.
Pristine Endeavors, LLC onboards clients in many different regions of Las Vegas and preforms many different services, therefore, our schedule can fluctuate. We will try to accommodate each client’s services on the same day/timeframe each week, but we we may change the date/timeframe at our sole discretion and without any notice.
Pristine Endeavors, LLC keeps detailed documentation of each time we do a service visit to the customer’s pool. We record through our pool tech app, the time at which we arrive at the residence each week. When we arrive, we promptly begin working netting the surface of the pool, vacuuming when needed (not done on every visit) testing the chemical levels and water balancing of the pool, chemically treating any imbalance that could happen within the week, (such as debris contamination from wind, rain storms, temperature changes, etc.) emptying filter and pump baskets, and checking the equipment. We notate in our app the chemical reads, any notations of things we notice and lastly take photos of the pool, spa and equipment. This information is kept for our records. If the pool is working and looking great, we do not burden our clients, as you will be able to see that your pool has no issues. If we do find issues, we will contact your directly, via email or phone.
Your monthly service fee goes towards 4 weekly visits per month for a maximum of 1 hour per service visit, chemical costs (if we are providing chemicals) our professional knowledge of water chemistry and making sure the customer’s pool and equipment are properly working and maintained. There is no set amount of time that our techs will be at the residence. We may need to be there for 45 minutes or we may need to be there for 5 minutes to ensure that the pool is properly maintained, clean and running correctly. Should Pristine Endeavors, LLC need to be at a pool for longer than the 1 hour max, the additional time will be billed at $2/minute.
Should a client want access to our records or be provided with weekly records of service, Pristine Endeavors, LLC offers this only upon request and at an additional administrative fee or $7 one time, or $19/monthly. We try to always keep our monthly cost of service as low as possible. If we are to send reports to clients, it takes added time, which we then have to accommodate for via the monthly fee.
Client agree to a monthly contractual term of service.
Pristine Endeavors, LLC is certified and insured and will maintain the confidentiality of the Client’s property.
Once a client’s monthly service has been initiated in our bill pay system, we immediately create that client’s account and add them to our weekly route on a particular day/time. The first payment goes directly to extensive administrative work that goes into organizing that client’s account in our system so that their pool service is streamlined with efficiency. Therefore, once the account has been registered through Pristine Endeavors, LLC it can not be refunded.
The first payment activates the client’s service and becomes the first day of their service term.
Pristine Endeavors, LLC accept all major credit and debit cards. We do not accept cash or check. When we onboard a new client, we add them to our project route on a certain day and time. That client then holds a spot in our schedule indefinitely (until their account is paid in full, cancelled and closed out.) We come out to their residence each week to provide services.
Because of this, we set up our payments for our clients as a subscription, since the service we offer is a subscription service. Each month, the client will be billed the same amount on the same day of the month. In order to do this and make it as convenient as possible for our clients, we have to have a credit or debit card on file. (Just as other subscription services do, such as Netflix or Amazon Prime.)
Credit cards may be billed up to seven days in advance of the due date to assure that service will not be affected if there is a problem with the credit card.
In the event that a client’s monthly service fee does not process correctly, we will contact the client to resolve the balance. If the payment(s) is not satisfied within 10 days, we will discontinue service and a reinstatement fee of $59 will be due, in addition to the balance owed and late fees, to resume service and bring the account current.
If you would like to cancel your service before the end of any given month of service, we require 30 days written notice from your monthly billing date. You will be billed one final billing cycle and then your account will be canceled. No refund is given. If your cancellation request is within the first 12 months of service, a $275 cancellation fee will be applied to your account and must be satisfied before the account can be closed. For commercial accounts, the cancellation fee is equal to the balance of the remaining months of service, per a 12 month term.
All cancellation requests must be emailed directly to Pristine Endeavors, LLC at cancel@cleanpoolsvegas.com. All cancellations will require the client to sign a cancellation agreement and pay the final total before the account can be cancelled.
It is the client’s responsibility to secure email confirmation from Pristine Endeavors, LLC that the service has been cancelled. If the client has not yet received email confirmation of service cancellation, then the account remains active, and the client will continue to be invoiced/billed. Clients are responsible for all charges associated with a service until cancellation is verified via email. If the client has a balance due at the time of cancellation, this balance must be paid in full or the cancellation may be refused until such a payment is made.
If the client has a payment method on file, Pristine Endeavors, LLC reserves the right to charge the client any remaining balance without further notice to the client for the total balance on their account.
Cancellation does not absolve client of any outstanding financial obligations. Pristine Endeavors, LLC reserves the right to go through third-party collection agencies to collect any overdue payments. All accounts sent through a third-party collection agency will have an additional fee of 38% of the amount owed, added to cover the collections fees and other related expenses, subject to applicable laws.
Pristine Endeavors, LLC considers all credit card chargebacks for services rendered, or partially rendered, to be fraudulent. Such accounts will be assessed a $75 fee, per incident, and have their balance sent to a third-party collections agency, as well as our attorneys.
In accordance with the service put in place by this agreement, Pristine Endeavors, LLC may use 3rd party products or services. The flat rate cost of associated products or services may be separately billed to the client through or for the 3rd party. Should any monthly service charge be associated with a 3rd party, the client is fully responsible for those monthly charges. Pristine Endeavors, LLC is not responsible for any 3rd party costs, cancellation fees or liability of 3rd parties.
Pristine Endeavors, LLC is not liable for the upkeep of 3rd party products or services, including but not limiting, pumps, filters, vacuums, mechanics, electrical, plumbing, etc. Should a 3rd party product or service become obsolete or cease updates, Pristine Endeavors, LLC is not responsible to replace the functionality or provide service on or for it.
Pristine Endeavors, LLC and the Client agree that any dispute arising out of this Agreement shall first be resolved by mediation, if possible. This contract was entered into with Pristine Endeavors, LLC based out of Sheridan County, Wyoming, and any necessary arbitration or litigation will take place in this county. These terms of service as well as the entire transaction are governed by Wyoming law.
Should any additional work be needed, or any work that does not fall under the current plan the client is on, all work will be performed at our hourly rate of $120/hour. (Which is billable at $2/minute) Should the Client’s Pristine Endeavors, LLC plan be canceled for any reason, all prior work will be subject to our hourly rate of $120/hour – $2/minute.
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
By a Client submitting their credit card information to Pristine Endeavors, LLC, the Client is authorizing Pristine Endeavors, LLC to process service payments, process cancellation payments, process additional maintenance payments, or process remaining balance payments, of agreed-upon services, with the card information on file, without notice to the client.
When the Client pays their first invoice through our payment processor Stripe, it is imperative that the client checks their total and if they have already previously created an account. If the client pays a different amount or creates multiple subscriptions, they did not intend to, we will credit the additional payment made to their account for services. We do not offer any refunds.
In addition, by a Client submitting their credit card information to Pristine Endeavors, LLC, the client authorizes Pristine Endeavors, LLC to charge their card each month for monthly services. The Client hereby understands that Pristine Endeavors, LLC provides a service and that services, once rendered, cannot be refunded. Client also hereby states that he/she will not dispute the charges to their card that have been set forth in this Pristine Endeavors, LLC Agreement or in additional invoices.
By entering into work with Pristine Endeavors, LLC, the Client’s billing information and payment serves as their “signature” to this agreement.
The Client acknowledges that the payment due upon commencement shall be non-refundable and shall be in consideration of the initial administrative actions taken by the Pristine Endeavors, LLC office. All actions will be taken to see that any issue can be resolved.
By requesting services from Pristine Endeavors, LLC, you are requiring us to allocate time in our schedule for your pool. Your pool will hold that spot and prevent us from filling that spot.
If the Client fails to make any payment for services rendered, as agreed to herein, services will be halted after 10 days of non-payment and until all payments, reinstatement fees and assessed late fees are satisfied. Payments that are 15 days past due accrue a late free of $25. Payments that are 30 days past due accrue a late free of $75. Payments that are 60 days past due accrue a late fee of $175. Payments that are 90 days past due will be required to pay a damages fee of $300. Collection efforts will begin when the account is 20 days past due. Monthly service payments will continue to be due and enforceable until the account is cancelled per our aforementioned cancellation procedure and policy.
E-mail/phone consultation: Pristine Endeavors, LLC will provide a 30 minute, free consultation, via phone, email or chat to new prospective clients. Once service has begun and initial payment has been received, up to 15 minutes per month communication via phone, email or in person will be included in the service price. This includes general orientation, education, tutoring, etc.
Telephone calls, Conference calls or any additional communication, outside of the allotted time allotment, may incur additional charges. Additional education, general consultation, unforeseeable troubleshooting, 3rd party phone calls, additional service visits outside of the client’s weekly service visit or any communication needs that may arise, are billed at our hourly rate of $120/hour. (Which is billable at $2/minute)
Pristine Endeavors, LLC reserves the right to refuse service to any Client should that Client engage in unprofessional conduct with Pristine Endeavors, LLC or its subcontractors. Unprofessional behaviors may include but not limited to: Profanity, discrimination, harassment, defacing Pristine Endeavors, LLC’s reputation utilizing social media, networking or any other means, threats of slander, libel, blackmail, or unethical practice. If a client engages in any of these or other unprofessional practices, Pristine Endeavors, LLC will halt services immediately and resolve unfinished work per the Refund Policy. Should any of these activities prove unlawful, Pristine Endeavors, LLC will pursue legal action to the full extent of the law.
Pristine Endeavors, LLC’s Ethics & Moral Clause: We provide a professional service. Hard work and dedication goes into everything we do. Insults, harsh words, aggression, put-downs, or otherwise rude feedback or communication will NOT be tolerated. If a professional and respectful working relationship can not be upheld, Pristine Endeavors, LLC will immediately cancel the client, no refund will be offered on services rendered to that point and remaining balance shall be due immediately. Behavior and cancellation is completely at Pristine Endeavors, LLC’s digression.
By engaging in any work electronically or otherwise with Pristine Endeavors, LLC, you are agreeing to these contract terms. Moving forward with Pristine Endeavors, LLC services and/or your payment, serve as your “signature” to this contract. You the Client accept the Pristine Endeavors, LLC Terms and Conditions, as they may be included with this Agreement, or as they may be further amended, at the sole discretion of Pristine Endeavors, LLC. A complete and correct copy of Pristine Endeavors, LLC Terms and Conditions may be found at this website (www.CleanPoolsVegas.com/terms), or will be provided upon request.
These Terms and Conditions shall be read and interpreted by the Client themselves, along with any such contract entered by Pristine Endeavors, LLC and the Client.
Pristine Endeavors, LLC encourages interested users to seek outside counsel to review our terms and conditions before engaging in services with Pristine Endeavors, LLC.
